Alaska Workers Compensation Insurance

According to the Alaska Workers Compensation Act any employer having one or more employees is required to carry workers compensation insurance. The only exception is if the employer has been accepted as a self-insurer. The relative-nature-of-the-work-test can be used to determine employee status as set out in Alaska Regulation 8AAC45.890.

There are a small number of general exceptions to those who require to be covered under workers compensation insurance.

These include:
• General partners in a partnership
• Sole proprietors in a sole proprietorship
• Executive officers in a nonprofit corporation
• Members in a member managed Limited Liability Company
• Part-time baby-sitters, cleaning persons (non-commercial)
• Harvest help and similar part-time/transient help
• Sports officials for amateur events
• Contract entertainers
• Commercial fishers
• Taxicab drivers whose compensation is supplied by contractual arrangement
• Any participant in the Alaska temporary assistance program
• Professional hockey team players or coaches who are covered under a health care insurance plan

Also, any executive officers in a for-profit corporation may be granted exemption by filing an Executive Officer Waiver with the department.
