Any employer who has four (4) or more full/part-time employees must provide workers compensation insurance. An employer engaged in the construction industry that employs one (1) or more part/full-time employees must also carry workers compensation insurance. State and local government you are required to carry workers compensation insurance. Farmers who have more than five (5) regular employees and/or twelve (12) or more additional workers for seasonal agricultural labor lasting thirty (30) days or more are also required to carry workers compensation coverage. An out-of-state construction employer having one (1) or more part or full-time employees that do work in Florida is required to acquire a policy through a Florida-licensed carrier.

Any individual serving as an officer of a corporation (the corporation must be registered with the Florida Department of State, Division of Corporations), who elects to be exempt may not recover workers' compensation benefits. You must meet eligibility requirements and provide documentation supporting your application.

Construction industry corporate officer, including a member of a limited liability company (LLC) applying for an exemption must own at least 10 percent of the stock of the corporation as shown by a stock certificate. In the case of a LLC a notarized statement attesting to the minimum 10 percent ownership is acceptable.

• Failure to report a work-related injury
• Deducting premiums out of employee pay.
• Maintaining operations in violation of a Stop-Work Order.
• Creating a false statement to obtaining workers compensation coverage or to reduce premiums.
• Firing or threaten to fire any employee for filing or attempting to file a claim.
• Misclassifying an independent contractor who is an employee.
