1. Does my Hawaii business need workers compensation insurance?

Yes, any employer, having one or more employees, full-time or part-time, permanent or temporary, is required to provide workers compensation insurance coverage for their employees.

 

2. In Hawaii is there any exemptions from carrying workers compensation insurance?

The following job descriptions are exempt from carrying workers compensation insurance. Voluntary or unpaid workers for a religious, charitable, educational or nonprofit organization, domestic workers earning less than $225 per calendar quarter. Select twenty-five percent stockholders, all fifty percent stockholders and real estate salespersons and brokers paid solely on a commission basis. An employer may, however, elect to provide workers compensation coverage for exempt employees.

Federal laws cover workers employed by the federal government and workers engaged in fishing, maritime and longshoring activities.

3. Does Hawaii workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Sole proprietors with no employees may elect not to carry workers compensation insurance coverage. Contractors must follow guidelines set forth for any other employer. Unless, they are operating as a sole proprietor.

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
