Idaho Workers Compensation Insurance

1. Does my Idaho business need workers compensation insurance?

Yes, any employer with one(1) or more employees is required to carry workers compensation insurance. If any of your employees is injured and you do not have workers' compensation insurance in effect at the time of the injury, you can be personally liable for all benefits, including medical and wage loss, provided under the Workers' Compensation Law. Employers who operate without a workers' compensation insurance policy, can be liable for a penalty of $2.00 per day per employee or $25.00 per day, whichever amount is greater. Operating a business without workers' compensation coverage is a misdemeanor under Idaho law and the employer/proprietor may be subject to criminal penalties.

 

2. In Idaho is there any exemptions from carrying workers compensation insurance?

There are some cases where you may elect coverage for exempt employment. It is recommended that you contact your insurance agent for more information on opting for coverage of exempt employment.

 

3. Does Idaho workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Employers who have contract workers, whether the contract implied is verbal or written, the workers may be considered employees under the Workers’ Compensation Law. Again, these cases are based on individually, so you should consult with your workers compensation insurance carrier to insure your in compliance. Sole Proprietors are exempt from carrying workers compensation insurance for themselves and immediate family members employed be them.

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
