1. Does my Illinois business need workers compensation insurance?

Yes, Illinois law mandates that all employers are required to carry workers' compensation insurance. This applies to every person, firm, public or private corporation, including hospitals, public service, religious or charitable corporations or associations who has any person in service or under any contract for hire, express or implied, oral or written, and who is engaged in any of the enterprises or businesses enumerated. There is no state fund. Employers may insure through private carriers, self-insurance, or through groups of employers.

2. In Illinois who can exempt themselves from Workers Compensation Insurance?

No, there are no waivers permitted and there are no exemptions for employers with small numbers of employees. However, an exemption does exist for employers with two (2) or less employees involved in carriage by land, water, or aerial service and any loading and unloading related to that service.

Sole proprietors, business partners, corporate officers, and members of limited liability companies may opt to exempt themselves.

3. Does Illinois workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Employers who directly or indirectly engage any contractor whether principal or sub-contractor to do any work is liable to pay compensation to the employees of any such contractor or sub-contractor unless the contractor or sub-contractor has their own workers' compensation insurance policy.

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
