1. Does my Indiana business need workers compensation insurance?

Yes, all employees must be provided with workers compensation insurance coverage.

2. In Indiana is there any exemptions from carrying workers compensation insurance?

The following categories of employees are exempt from workers compensation insurance and cannot elect optional coverage.

*Railroad Employees
*Employees in Federal Commerce
*Real Estate Professionals
*Independent Contractors
*Volunteers & Coaches

3. Does Indiana workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Independent contractors in the building and/or construction trades are required to become certified with the Indiana Worker’s Compensation Board. Injuries occurring while working as an independent contractor will NOT be covered by worker’s compensation. However, injuries sustained while working as an employee might be covered.

A sole proprietorship may elect to cover the owner as an employee for workers compensation insurance coverage if the owner is actually engaged in the proprietorship business. However, the owner must serve written notice of the election upon the owner's insurance carrier

 

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
