1. Does my Kentucky business need workers compensation insurance?

Yes, all employers, both public and private, are required by Kentucky State Law to provide workers' compensation insurance coverage for their employees, including corporation executives. Employees continue to be covered when they are sent out of Kentucky on temporary work assignments as well. Employees may reject workers compensation insurance coverage according to the Workers Compensation Act. However, they still retain the right to take legal action for wrongful injury or neglect on the job.

2. In Kentucky is there any exemptions from carrying workers compensation insurance?

Federal employees, domestic workers, most farm workers and certain casual workers are exempt from workers compensation insurance coverage. Business owners and certain qualifying partners may elect not to carry workers compensation coverage for themselves.

3. Does Kentucky workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Sole Proprietors may elect not to carry workers compensation insurance coverage. Subcontractors/ Independent contractors must follow same guidelines as all other employers once they have been classified as such.

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage.
