1. Does my Maryland business need worker's Compensation Insurance?

With few exceptions, every employer with one (1) or more employees is required by law to provide workers' compensation insurance. The entire cost of workers' compensation insurance must be borne solely by the employer. Workers' compensation insurance may be provided through a competitive state fund, a private insurance carrier, or employers may self-insure.

2. Who can exempt themselves from Maryland workers compensation Insurance?

Agricultural employers with less than three (3) employees or an annual payroll for full-time employees which does not exceed $15,000, are not required to carry worker's compensation insurance. Office workers Independent contractors working on farms, with the exception of migrant laborers, are excluded from coverage. Domestic servants and their employers may jointly elect to be covered by the act, even if the worker would not otherwise meet the earnings requirement.

3. Does Maryland workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Unless you meet any of the criteria listed above, there are no other distinctions made regarding sub-contractors/contractors. Sole proprietors with no employees may choose whether or not to carry wokers' compensation insurance.

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
