·      Any person whose employment is both casual and not in the course of the trade, business, profession or occupation of his employer.

·      Any person engaged as a theatrical or stage performer or in an exhibition.

·      Musicians whose services are casual in nature and not lasting more than 2 consecutive days, and not recurring for the same employer, as in wedding receptions, private parties and similar miscellaneous engagements.

·      Individuals engaged in household services, farm, dairy, agricultural or horticultural labor, or in stock or poultry raising.

·      Any person performing services as a voluntary ski patrolman who receives no remuneration for his services other than meals, lodging, or use of the ski tow or lift facilities.

·      Clergyman, rabbi or lay reader in the service of a church, or any person holding a position with respect to any other religion.

·      Real estate broker, broker-salesman or salesman licensed.

If you meet any of the below criteria you are recognized as the "principle contractor,” therefore, you are considered the employer of independent and sub-contractors for the purpose of being responsible for providing workers compensation insurance.

 

·      Coordinate all the work on an entire project

·      Obtain the contract to complete an entire project

·      Utilize the services of any subcontractor or independent contractor

·      Issue payment to any contracted subcontractors or independent contractors

 

Sole proprietors and partners of a partnership may elect whether or not to carry workers compensation insurance.

Employers who fail to carry required coverage are subject to an administrative fine up to $15,000, as well as premium penalties (missed premium payments). They also may be forced to close business until insurance is instated, and made financially responsible for any costs related to a work-related injury. There also may be a criminal penalty for any claims that lead to substantial bodily harm or death (NRS 616D.200 & NAC 616D.345).
