Ohio Workers Compensation Insurance Rules

Ohio Workers Compensation

1. Does my Ohio business need workers compensation insurance?

All employers with one(1) or more employees must carry workers compensation insurance coverage.

2. In Ohio is there any exemptions from carrying workers compensation insurance?

Ohio law makes coverage elective for those who are engaged in one of the following categories:

Sole Proprietor
Partnerships
Limited liability company (LLC) acting as a sole proprietor
Limited liability company (LLC) acting as a partnership
Family farm corporate officers
Individual incorporated as a corporation (with no employees)
Ordained or associate ministers of a religious organization

3. Does Ohio workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Independent contractors and subcontractors may exempt themselves from coverage if they are sole proprietors or partners. If an independent contractor or subcontractor controls the selection of materials, quality of performance of another worker, that independent contractor or subcontractor is considered an employer and, as such, is required to provide workers compensation insurance for that worker.

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
