Oregon Workers Compensation Insurance

1. Does my Oregon business need workers compensation insurance?

The state of Oregon requires almost all employers to carry workers' compensation insurance on their employees. If you employ workers in Oregon, you probably need workers' compensation insurance coverage.

 

2. In Oregon who can exempt themselves from Workers Compensation Insurance?

There are no numerical exemptions from workers' compensation insurance in Oregon. Under certain circumstances independent contractors may file for an exemption.

 

3. Does Oregon workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

If you employ an individual that you believe to be an independent contractor but is determined to be a worker, then you are the employer and responsible for providing workers' compensation insurance coverage.

To be considered an Independent Contractor under Oregon State Law you must be:

* Free from direction and control

* Licensed under Construction Contractors Board, State Landscape Architect Board, State Landscape Contractors Board or State Board of Architect Examiners, if required for service

* Responsible for other licenses or certificates needed to do the work

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.

 

USL&H & The Jones Act


We have excellent programs for specialty risks requiring this endorsement. Minimum premium for a USL&H endorsement usually start out at $2,500.00 plus the cost of the workers compensation insurance.
