Workers compensation insurance coverage is mandatory for all Pennsylvanian employers who have one or more employees, part-time or full-time, including family members. Executives are also considered employees of a corporation.

There are a few exceptions for those who are not required to carry workers compensation insurance including sole proprietor or partners, domestic service or casual workers, agricultural workers (unless the employer pays wages of $1,200 or more in one year to one employee or employs one worker in one year for 30 or more days), any employee who is a member of a religious sect and licensed real estate sales people or licensed insurance agents.

Contractors are responsible for the payment of compensation benefits to employees of its uninsured subcontractors. Therefore, if you hire an uninsured subcontractor you will be charged a premium for the compensation you pay to that uninsured subcontractor. Sole proprietors with no workers are not required to provide coverage. It must be proven however, that worker is in fact an independent contractor.
