Attention Tennessee Construction Industry

Recently Tennessee Bill H-1645 amended the law to require any person engaged in the construction industry as a principal contractor, intermediate contractor or subcontractor to carry workers’ compensation insurance effective December 31, 2009. Pursuant to this change in law, your workers’ compensation insurance policy may have been endorsed to provide this coverage.   You should check with your current agent and make sure you have an exemtion signed now or it could cost you allot of money at audit time. Effective January 22, 2010, the Tennessee Legislature passed SB7001 & HB7007 that removes the requirement for sole proprietors and partners who are engaged in the construction industry to carry workers’ compensation coverage on themselves.  At this time the state has removed the coverage requirement; however, it will be reinstated on March 28, 2011.

 

1. Does my Tennessee business need workers compensation insurance?

Every employer with five or more full or part-time employees must carry workers' compensation insurance. Employers engaged in the mining and producing of coal must also carry workers' compensation insurance.

2. In Tennessee who can exempt themselves from Workers Compensation Insurance?

Exemptions do exist for certain employers, such as farm labor, domestic help and government agencies. However, they may elect to provide workers' compensation insurance. Owners can choose to be excluded by completing the i-4 form.  The minimum payroll for a sole prop in TN is $49,200 when determining workers compensation rate

3. Does Tennessee workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

All contractors in the construction industry with one (1) or more employees must provide workers' compensation insurance. A Sole Proprietor or partnership may choose whether or not to carry workers compensation insurance.

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage. We represent numerous leasing and staffing companies who in many cases offer deep discounts on your workers compensation coverage that you will not find from standard workers compensation insurance carriers.
