West Virginia Workers Compensation Insurance Rules
1. Does my West Virginia business need workers compensation insurance? Yes, employers are required to provide workers compensation insurance for all employees. Both full and part-time employees who have fulfilled thirty(30) work days.
2. In West Virginia is there any exemptions from carrying workers compensation insurance? Sole Proprietors who have no employees may exempt themselves from workman's compensation insurance. Corporate officers may elect to exempt themselves from workers compensation insurance once they file form with necessary agency.
3. Does West Virginia workers compensation law have specific requirements for subcontractors/contractors and sole proprietors? Subcontractors/contractors are required to carry workers compensation insurance for their employees and be able to furnish proof. If acting as sole proprietors, subcontractors/contractors, are exempt from carrying workman's compensation insurance. However, any employer contracting them for their service must bear the responsibility for providing them with workers compensation insurance coverage. Employee Leasing and Staffing Companies Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage.
