1. Does my Wyoming business need workers compensation insurance?

Wyoming is one of five monopolistic states that provide State Funded Workers Compensation Insurance Coverage. It is required that all employees working in any industry deemed extra hazardous must be covered by workers compensation insurance.

*Mining
*Utilities
*Construction
*Manufacturing
*Wholesale Trade

Businesses that do not fall under extra hazardous classification, may obtain workers compensation insurance from a private carrier.

2. In Wyoming is there any exemptions from carrying workers compensation insurance?

If your business does not fall into any of the above categories, you may elect not to carry workers compensation insurance. Therefore, classifying you as exempt from coverage. However, you are not relieved of your liability from possible financial responsibility and lawsuits from injuries sustained by your employees.

3. Does Wyoming workers compensation law have specific requirements for subcontractors/contractors and sole proprietors?

Sole proprietors are not required to carry workers compensation insurance.

Independent contractors acting as sole proprietors do not require workers compensation insurance coverage. However, if they have any employees, they will be subject to the same responsibilities as any other employer.

 

Employee Leasing and Staffing Companies

Using a PEO or staffing company to obtain your workers compensation may be a good alternative to purchasing your own workers compensation policy. Leasing companies handle your payroll, w-2 forms, unemployment and workers compensation claims. In many cases the down payment required to obtain a new workers compensation policy is high and many new businesses cannot afford the down payment. Another advantage, based on my experience, is that you will never get audited because you pay as you go for your coverage.
